Terms of Service

These Terms of Service (“Terms”) govern your use of baack.it (“we”, “us”, or “our”) and all related services. We reserve the right to update these Terms at any time. Changes take effect immediately upon posting.

By accessing or using baack.it, you agree to these Terms. If you do not agree, you must not use the service.

1. About baack.it

baack.it is a SaaS platform for payment, subscription, and access-management automation for private communities. The service allows independent merchants such as coaches, educators, community operators, professional communities, educator-led learning groups, digital service communities, and other family-friendly operators to create a branded page and sell subscription access to their own private Discord or Telegram groups.

The core product sold through baack.it is access to private community groups managed by the merchant. Merchants may create branded pages, add text, images, videos, FAQs, reviews, social links, and pricing plans, and connect Discord or Telegram so that customers who subscribe receive access automatically. If a customer cancels or a payment fails, baack.it may automatically remove access from the relevant group.

baack.it is not a creator marketplace. We do not provide a public marketplace, creator discovery, searchable creator listings, feed-based content discovery, or a platform where end users browse and purchase from multiple creators. Each merchant operates their own branded page and shares their own page link directly with their own audience or customers.

baack.it is also not an adult-content platform, fan-content platform, tipping platform, donation platform, gambling platform, betting platform, sports-picks platform, investment-signal platform, financial-advice platform, crypto-signal platform, or peer-to-peer money transmission service.

2. Accounts and Eligibility

To use certain features, you must create an account. You agree to provide accurate information and to keep your account secure. You are responsible for all activity under your account.

You must be at least 18 years old, or the age of legal majority in your jurisdiction, to use the service. You must comply with all applicable laws when using the service.

3. Merchant Pages and User Content

Merchants may publish content including text, media, links, community descriptions, service descriptions, membership benefits, pricing terms, FAQs, reviews, and social links. The page builder is provided so merchants can describe their own lawful community, service, and membership offering. The primary purpose of the service is subscription checkout and automated access management for external private communities, not the operation of a content marketplace.

You are solely responsible for any content you publish and for ensuring it complies with applicable laws, these Terms, Stripe’s rules, and the rights of others.

We may review merchant accounts, pages, communities, pricing plans, and published content before or after publication to help enforce these Terms, Stripe’s rules, applicable law, and our acceptable use standards. Approval to use the service does not waive a merchant’s ongoing obligation to comply with these requirements.

4. Subscribers and Community Access

Merchants may offer access to external private communities and platforms. Subscribers understand that access depends on third-party platforms and merchant settings. We are not responsible for the availability, actions, or policies of external platforms or merchant-managed communities.

Access is granted upon successful payment and revoked upon subscription cancellation, expiry, or failed renewal. baack.it automates this process but cannot guarantee uninterrupted access due to third-party platform limitations.

5. Payments, Subscriptions, and Platform Fees

baack.it does not process payments directly. All payments are processed through Stripe Connect Standard. Merchants are required to connect their own Stripe account through Stripe’s standard onboarding flow to accept payments. Payments are processed on the connected merchant’s own Stripe account. By using baack.it, you agree to comply with Stripe’s Terms of Service, including Stripe’s prohibited and restricted business rules.

baack.it charges a platform fee on each subscriber payment made through a merchant’s page. This fee is deducted automatically via Stripe and depends on the merchant’s active plan:

Stripe’s own processing fees apply in addition to the platform fee and are outside baack.it’s control.

Subscriptions renew automatically at the end of each billing period unless cancelled by the subscriber. Merchants are responsible for managing their own pricing, offers, and any subscriber-facing obligations.

baack.it does not hold customer funds, does not collect funds on behalf of merchants for later redistribution, does not provide peer-to-peer money transmission, and does not manage funds on behalf of merchants. All funds are processed and delivered directly through merchants’ connected Stripe accounts. baack.it is not liable for payment disputes, chargebacks, or failed payments between merchants and subscribers.

6. Refunds

baack.it does not issue refunds directly. Refund requests must be directed to the merchant of the relevant page. Merchants are solely responsible for their refund policies and for processing any refunds through their Stripe account.

baack.it is not liable for any disputes between merchants and subscribers regarding refunds or chargebacks.

7. Merchant Tax Obligations

baack.it does not collect or remit taxes on behalf of merchants. Each merchant is solely responsible for determining and fulfilling their own tax obligations in their respective jurisdiction. This includes VAT, sales tax, income tax, and any other applicable levies.

You agree not to:

We reserve the right to review merchants, pages, communities, pricing plans, and content; request additional information; reject or remove pages; disable checkout; suspend access; terminate accounts; and report activity to Stripe or other relevant providers if we believe a merchant or page violates these Terms, Stripe’s rules, applicable law, or our acceptable use standards.

9. Intellectual Property

All rights in the platform, excluding user content, belong to baack.it or its licensors. You may not copy, modify, distribute, or reverse engineer any part of the service without permission.

10. User Content License

By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to use, host, display, and distribute your content as necessary to operate the service. You retain ownership of your content. This license terminates when you delete your content or close your account.

11. DMCA and Copyright Infringement

baack.it respects intellectual property rights. If you believe content on the platform infringes your copyright, please send a written notice to support@baack.it including:

We will respond promptly to valid DMCA notices and remove infringing content where appropriate.

12. Suspension and Termination

We may suspend or terminate your access at any time if you violate these Terms or use the service in a way that may harm the platform or others. Upon termination, your right to use the service ceases immediately.

13. Third-Party Services

baack.it integrates with third-party services including Stripe (payments), Supabase (infrastructure), Telegram, and Discord (community access). We are not responsible for the availability, actions, or terms of these services. Your use of third-party services is governed by their respective terms.

14. Disclaimers

The service is provided “as is” and “as available” without warranties of any kind. We do not guarantee that the service will be uninterrupted, secure, or error-free. We are not responsible for the actions, content, or omissions of merchants or subscribers.

15. Limitation of Liability

To the maximum extent permitted by law, baack.it shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of or inability to use the service. This applies whether the claim is based on warranty, contract, tort, or any other legal theory.

16. Consent to Electronic Communications

By using baack.it, you consent to receive transactional emails and service-related communications from us, such as OTP verification codes, subscription confirmations, and account notices.

17. Modifications to These Terms

We may update these Terms at any time by posting the revised version on this page. Continued use of the service after changes are posted constitutes your acceptance of the updated Terms. It is your responsibility to review these Terms periodically.

18. Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision will be severed and the remaining Terms will continue in full force and effect.

19. Privacy Policy

Your use of the service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
